A foreign investor refers to a person that is not ordinarily a resident of Australia. It does not include Australian citizens that are currently expats.
For Corporations, if the controlling interest (15% or more) is owned by a foreign person, the corporation is considered to be a foreign investor. This also applies to trust funds.
